I'm not a mother, but in the coven I was trained in I was considered a bit strange because I didn't want babies. Many of my witchy friends are parents - and I often hear them bemoaning the fact that there are so few She adds: "All of us are implicated in the raising of children, in the raising of a healthy new generation, whether or not we are parents." And seeing as I have tried to write child-friendly rituals in the past and hope to do so again, I feel I could do with all the advice I can get on that matter.
Children of the Green looks at the issues of bringing up children in terms of the elements - earth representing children's physical needs, air their minds, fire their activities and also their wants and water their emotions. It also looks at the fifth element - spirit.
For many Wiccans, a big dilemma is whether to tell their children that they are witches. Some feel it is best kept secret until their kids are in their mid teens because of the stigma that is still attached to witchcraft. They don't want their children teased at school because of it - some even fear that if their child reveals their secret to outsiders, people might consider them to unfit parents simply because of their beliefs.
That is a choice each parent has to make on their own. However, Children of the Green shows ways in which children can be brought up with pagan spirituality as a part of their life. It looks at the theories behind childcare techniques as well as ways to teach youngsters a pagan way of looking at the world. It also includes practical exercises such as grounding meditations that can be done even with five-year-olds; teaching the cycles of the season by growing, harvesting and cooking vegetables in the garden; telling them stories from pagan mythology; using herbs as part of the family first-aid chest and performing simple, seasonal rituals that they can take part in.
The book is well researched, thought-provoking and, I would think, offers much for pagan parents to consider and perhaps adapt for their own use.

The doctor says I have a terminal disease? In spite of that, fear will not consume me. My spouse has asked for a divorce? Come what may, I will contend for restoration. I lost my job and have used all of my savings? Regardless, I will continue to believe that God is my provider. A fire has taken my home and all my possessions? David begins this section of Psalm 23 with a statement of determined faith in his Lord. Despite whatever catastrophes life might hurl at him, David proclaims that he will stand in contradiction to them. He can speak confidently because David is intimately connected to his Shepherd. In order to experience the same intimacy with the Lord as did David; we, too, must fight our natural inclination to be fearful in in the face of difficulty. Instead, we need to find a way to stand in contradiction to it.
How can we be as confident as David?

Remember it's a "valley" not an "alley" - there's not a dead end. The trial you are facing will not last forever, so hang in there and determine to keep plodding ahead. It is not God's intention for you to quit, become stranded, or ensnared in your valley. He wants you to grow as you proceed through, so keep on moving!
How do you keep moving?
* Keep your eye on the prize: "For indeed while we are in this tent, we groan, being burdened, because we do not want to be unclothed but to be clothed, so that what is mortal will be swallowed up by life." 2 Corinthians 5:4
* Remember your context: "Therefore, since we have so great a cloud of witnesses surrounding us, let us also lay aside every encumbrance and the sin which so easily entangles us, and let us run with endurance the race that is set before us." Hebrews 12:1
* Fix your eyes on Jesus: "Fixing our eyes on Jesus, the author and perfecter of faith, who for the joy set before Him endured the cross, despising the shame, and has sat down at the right hand of the throne of God." Hebrews 12:2

In order to experience the exhilaration of the mountaintops of our lives, we have to endure the challenges of the climb. Every step we take, every obstacle we overcome, and every fear we conquer makes us stronger. It is the very struggle during the ascent that makes the summit all the more spectacular. Don't shirk the hard road; it will reward you in the end.
How does God want us to endure the hard things?
* Resolve to not quit: "For consider Him who has endured such hostility by sinners against Himself, so that you will not grow weary and lose heart." Hebrews 12:3
* Get up if you stumble - maturity is a process: "And not only this, but we also exult in our tribulations, knowing that tribulation brings about perseverance; and perseverance, proven character; and proven character, hope." Romans 5:3-4
* Permit endurance to produce God's change in you: "And let endurance have its perfect result, so that you may be perfect and complete, lacking in nothing." James 1:4
"3. IN THE MIDST OF THIS REALITY, CHOOSE TO ACKNOWLEDGE DEATH:"
Death is always an option in this journey of life. Its shadow lurks in every nook and cranny of our lives. Death resides in the diagnosis, the unexpected termination, a sudden accident, and an abandoned dream. Nevertheless, Jesus did conquer death for us and his broken body is our greatest blessing.
How can I best acknowledge death without succumbing to fear?
* Celebrate Christ's victory over death: "O death, where is your victory? O death, where is your sting?" 1 Corinthians 15:55
* Rejoice In Christ's resurrection and the victory it provides for you: "But thanks be to God, who gives us the victory through our Lord Jesus Christ." 1 Corinthians 15:57
* Stand in your authority as a conqueror! : "But in all these things we overwhelmingly conquer through Him who loved us." Romans 8:37
"4. IN THE MIDST OF THIS REALITY, CHOOSE TO ADOPT FAITH OVER FEAR:"
Death is scary because it is unknown, but David confidently calls out death when he says, "Even though I walk through the valley of the shadow of death, I fear no evil for You are with me..." He acknowledges the presence of death in his valley, but David also puts death in its proper perspective. The "shadow" of death exists because there is a light source illuminating it. David is never alone with death in that valley because the "shadow" indicates the very presence of God himself.
How do we know we're not alone in the valley?
* God sent Jesus to be the light that casts a shadow over death: "In Him was life, and the life was the Light of men." John 1:4
* Jesus declared Himself to be that light: "While I am in the world, I am the light of the world." John 9:5
* God has promised to always be with us: "I will never desert you, nor will I ever forsake you." Hebrews 13:5b
"5. IN THE MIDST OF THIS REALITY, CHOOSE TO WALK WITH JESUS:"
My first boss was a former naval officer. As a result, he was a stickler for details, and a resolute "worst case scenario" person. Often when we were writing and rewriting employee policy, he would ask me, "Okay, what if this person dies?" To my 21 year-old mind, it was jarring, morbid even. As the years have passed, however, I've seen the wisdom in it. He wanted to be sure the university insurance programs resourced its employees even in their most desperate hour; when death arrived.
I believe walking intimately with God to be the only insurance plan capable of resourcing me through any and every trial a valley might present. God's presence in my valley will provide the light I need to see and the confidence I need to keep traveling "through."
How do we walk intimately with Christ?
* Draw near to Him: Draw near to God and He will draw near to you." James 4:8a
* Recognize that God is full of mercy and grace, and He is anxious to resource your need: "Therefore let us draw near with confidence to the throne of grace, so that we may receive mercy and find grace to help in time of need." Hebrews 4:16

For the following week, a strange chaos of events is likely to occur across the planet. This will be in the political and social arena, involve the war theaters - and also include UFO sightings, and At the same time, the brutal money monopoly that has been placed over humanity, worldwide, is being tightened, and a militaristic regime is being introduced incrementally. Any manner of catastrophe, natural or not, will be used as an excuse to implement this 'papers, please' regime.
There is an interesting dichotomy occurring at this moment in history. Fear as the great controller of populations is being used and heightened to the 'nth' degree by the corrupt powers that be. Simultaneously, FEAR is losing it's grip on many who see through the constant, intense manipulation. Thus, 'fear' is now fueling a great opposition against those who wield it like a horrific weapon.
On a personal level this week, and for the month of October, know action-packed days are likely ahead. This means much can and will be accomplished. However, you must seek times of rest or risk becoming burned out. This month is also a wonderful period of time to establish enduring relationships.
From this point forward, the Aquarian desire for true freedom and the ancient 'magick' of Arthurian legend, will join hands. This will be for the purpose of liberating humanity, and bringing forth the divine race. That is, our highest selves now emerge, and we become who we truly are spiritually.
Trendwise, love is in the autumn air. Now is the perfect time to enjoy all aspects of love. Also, romantic love is taking on a new life - leaping to a higher level of expression. This is because a new vision is emerging, one that is being reflected in romance novels, and other creative, artistic endeavors.
It becomes more and more important to watch your backside, and to watch over those you care the most for - all the 'beloveds' in your life.

Cliff and Tom, the Hanson brothers, scratched their heads and frowned. Any other time the trophy buck in the bed of their truck would have drawn a crowd. Especially in a backwoods town like Talbot's Peak, Montana. This far off the interstate, the place must be chocked full of hunters. People should be oogling their kill's rack or grumbling with envy.

"This is an article I wrote for Witchvox a couple years ago that discusses how to deal with the dark and wintery times of the year (particularly that time between Samhain and Yules when the sky is most dark). I think its important to pay attention to our moods, especially those who seem to have what we call "seasonal mood disorder". Why do people get that? What can be done to fix it, besides medication? Hopefully this will help someone who is asking those questions."
DEALING WITH THE DARKNESS, POST-SAMHAIN
In many of our traditions, most of us agree that the start of the Samhain season and the ushering in of the "Celtic winter" is a time to "deal with the darkness"-as my old priestess called it. As the wheel turns to October, then November, we begin to turn inwards and allow our spirits to rest until the light comes back again. Rest is an important theme for the dark half of the year, but not one that should debilitate us.
As Pagans, we relish and celebrate every time of the year. Yes, it is time for our spirits and emotions to take a break, but our practice shouldn't. I don't know about you, but after October 31st, I tend to get lazy. The running shoes get kicked to the back of the closet, the outdoor altar comes inside for the frost season, and the inevitable winter weight gain starts to take its hold. I tend to catch up on my reading this time of year, but I must admit that my daily practices, my daily devotions, often get pushed to the back burner in favor of holiday shopping and cookie baking.
Letting our practice ease up takes a toll on us in more ways than you might imagine. Do you ever get the winter frowns? There is a reason why 36 million Americans suffer from Seasonal Mood Disorder. The days get darker, the wind gets stronger, and the air gets colder. Solar energy that normally provides our bodies with so many essential vitamins and nutrients, are scarce. The ancients weren't the only ones who struggled with the winter months. We may not constantly face the threat of starvation every day, but our spirits can feel starved. There can become a cold void in our vital essence and energy, affecting everything we do.
The question then becomes; how do we face the darkness of the season, but keep just enough light alive to see us through?
The ancients had many ways of doing this that have worked their way into some wonderful modern traditions. Building a roaring hearth fire and telling stories used to be a staple of the winter season. Unfortunately, this has fallen in favor of television and video games, restricting us from vital human contact and communication. Though it is important to reflect in the time of darkness, communication with both people and the spirit world is extremely important.
Communication-ruled by mercury-is the lead archetype of western magick. Keeping your practice and communication alive is one of the best things you can do to keep your chin up, and your magick a sure-fire zap. Here are some ideas that come to mind:
Family Gatherings: On Samhain, we honored our ancestors and beloved dead, those who-by blood or friendship-were a part of our family units. Gatherings are still wonderful and important traditions in the winter season, but why just limit it to one or two? Plan a potluck with your family and friends. Instead of sitting around the TV, sit around and share stories of your family, of the season, and anything else that comes to mind. If you have a Pagan family, say a dedication in honor of Lady Brigit, goddess of the home and hearth. Dedicate your time to her and she'll be sure to make your "warm and fuzzies" stick around. There's nothing like a party to ease your winter woes, so keep em' coming!

Staying Active: It is proven fact that exercise can heal depression and make your feel better. Honoring our health and activity is just as important to our magick and spirituality as it is to our physical bodies. You don't have to do anything crazy. Are you in a snowy area? Brush off the old plastic sled and get to it! If you're just not a fan of the cold (like I am), try taking up yoga or The Written Word: As I mentioned, I love using the chilly weather to catch up on my reading. It takes my mind off the icy darkness for a little while and gets my inspiration pumping. Writing is also a great way to take advantage of the seasonal theme of the year. Writing connects us to our divine mind, the "inner flame" of our spirit.
Birthday Party for the Sun: I discovered this idea from a neighboring coven many years ago and have incorporated it into my seasonal activities every year. Though it seems to fit best on the Winter Solstice, you can do this any time that you wish to give the sun props and thanks for its blessings. Try baking foods associated with solar energy like lemon squares, cranberry cookies, and anything with orange in it. This can be incorporated into the "Family Gathering" idea if you invite a few friends over. Wear party hats, play games, and sing "Happy Birthday" to any of the solar deities (Apollo, Helios, Lugh, Ra, etc).
There are many other things you can do, so just let your imagination be your guide. Let these things become habit and as always, include the great work of Spirit in everything you do. It's fine to park it on the couch with a steamy mug of cider. It's fine to take a break. Just don't take a break from your connection with the divine. The dark half of the year doesn't have to be painful and icy if you don't let it.
Remember, the coming fire of the new year is right around the corner. Even if you can't see it, it's still there, ready to light up your life.

Pow Wow magick sometimes called Hex magick was primarily practiced in the state of Pennsylvania. It was a combination of Norse magickal practices, Christianity and Native American magickal practice. The state of Pennsylvania was founded by William Penn, a member of Britain's upper class. His father was a judge. William was a rather free thinker who believed in the rights of women and the right to choose your spiritual practices. He was rather outspoken about these beliefs and his father worried that could cause lots of problems, these were the times that anyone who disagreed with the church could be tried for witchcraft and burned at the stake. Eventually Great Britain gave him a tract of land as one of the colonies. He did so and it was one of the colonies that granted lots of religious freedom.
This was a boon for Europeans who engaged in magickal practices. Many of the colonist who came to settle in Pennsylvania hailed from the black Forest which the Rhine River flowed through. There were two groups of Germans who settled there. THe first group were protestants who tended to be simple austere people. The second group were German Catholics who tended to be wealthier and more colorful.
Pow Wow practitioners tended to be a quiet lot of people who did not want their practices to be associated with Witchcraft or magick. They tended to use herbs and chants for healing people. They also had spells to catch criminals, stop fires and wild dogs. Very rarely did they have practices pertaining to obtaining love or money.
Silver Ravenwolf has written a great book about this dying art of Magick. Herself a Wiccan she does note that there are differences between the two magickal systems. The Pow Wow being relatively inexpensive in terms of gathering material. While Pow Wow has been primarily Christian in it's outward orientation she has reworked some of the chants to a Wiccan perspective which is just as effective. Some may like this and some may not. Then again what magick is totally pure. They all have borrowed from others.
Pennsylvania was home to a variety of practioners. Some people practiced European Ceremonial Magick while others were Mason or British witches. There were also Rosicurians in Penn state as well. They all had to have had an influence on each other, Some Pow Wow practitioners communicated with these Ceremonial magicians via letter writing.

"Zen and the Art of Mototcycle Maintenance: An Inquiry into Values", by Robert M. Pirsig, is what is known as a "philosophical novel," which means that the story and the dialog are there as a device to discuss philosophical issues.
"Zen was "a hugely popular book in 1974, and it continues to earn new dedicated fans. It was one of my top five favorites published that year - a great time for novels! The other four:

In the story, the narrator takes a cross-country motorcycle trip with his son. Along the way, the repairs they make together are used to illustrate how to unify the objective, rational realm of technology with the subjective, imaginative realm of artistry. He encourages his son to become one with whatever activity he's involved in, to engage in it fully, to see and appreciate all its details, whether it's hiking in the woods, writing an article, or adjusting the chain on a motorcycle.
The following passage expresses one of the central, non-philosophical points:

A lot of what the narrator says algns with the personal strengths I often write about:

Birthing is a shamanic journey.
When we want to conceive we're enveloped by love. To make room for more love, we need to let go of beliefs that do not fit the mother we will become.
Let me give you an example. If we experienced isolation as a child and were unable to bond with a caregiver, as we try to conceive, our psyche can go into battle with our body. Our psyche can rebel and turn the energy of our body off. Because it knows love will bring up these forgotten sensations of our youth. And that can be scary.
The feelings we haven't acknowledged effect our ability to conceive and birth. Most of us who have experienced loss as a child have created a dynamic way of being that overrides our abandonment. It can be devastating to our ego to unearth our emotional truth.
How do we make room for our emotional truth so we can allow for conception and birth?
One mom-to-be was so engaged in caring for her entire family; mother, sisters, brother and father, that there was no room left for herself. She had been the go to person in her family since she was about 8 years old. In her session she was able to shift her perception of responsibility for the others back to herself. She could feel this release within her low back. After 8 months of trying to conceive, she became pregnant after her next cycle. She was ready for the change.
Many of the moms I have worked with regarding conception, pregnancy and birth know what is really going on. They know what the challenge is, and it's not usually what the medical diagnoses says.
When we validate what we know is working and what isn't working it's our first step as a parent. As we acknowledge ourselves, no matter what our experience has been, this knowing can create a base of acceptance and fertility. So no matter how we bring our child into our life we have made room for them.
The anxiousness, isolation or rebellion we may have felt as children does not need to take over our ability to create a family now. But we do need to listen to what we know is true. Once we acknowledge our true feelings and give them the light of day, the alchemy begins. This alchemy is our birth, it's our shamanic journey.

Sometimes when Christians go through rough times of trials, illnesses, pain unimaginable, etc..., we start questioning God. One thing we must remember is that God does not cause the bad to happen. He may allow it, but He never causes it.
James 1:17
Every good gift and every perfect gift is from above, and cometh down from the Father of lights, with whom is no variableness, neither shadow of turning.
Jer 5:25
Your iniquities have turned away these things, and your sins have withholden good things from you.
There can be many reasons that God will allow bad things to happen. He surely has some reasons that we cannot know until a later time, but we must hold on to our faith that He is a loving Father and knows better than we do what is good for us.
1. A major part of the problems we face is because of the law of sowing and reaping.
Gal 6:7
Be not deceived; God is not mocked: for whatsoever a man soweth, that shall he also reap.
Gal 6:8
For he that soweth to his flesh shall of the flesh reap corruption; but he that soweth to the Spirit shall of the Spirit reap life everlasting.
Gal 6:9
And let us not be weary in well doing: for in due season we shall reap, if we faint not.
Gal 6:10
As we have therefore opportunity, let us do good unto all men, especially unto them who are of the household of faith.
When we were sinners, we sowed bad seeds. We all have been sinners. Therefore, we must reap what we've sown. When we come to a time when we give our life over to Jesus Christ and believe that He suffered and died for our sins, and was resurrected the third day, we begin sowing good seeds. However, we are still reaping from our sinful past. Yes, God has forgiven and forgotten those past sins, but our flesh is still going to reap what it sowed. We can only reap corruption in the flesh while we are here on earth. I believe that is one of the reasons we suffer with so many illnesses and pains.
BUT, THERE IS HOPE! Galatians 6:9 tells us not to be weary in well doing for we shall reap in due time if we don't give up. In my own life, I'm still reaping some things from my sinful past, but I try my best to hold on to Jesus and let Him help me get through it. I've been a Christian for many years and have seen some of the good reaping, also. :-)
So you see, we have to take responsibility for our own actions. We do have choices in this life. The Bible tells us over and over to choose life and righteousness. We usually will not choose these good things until we give our life to Jesus Christ. He gives us His power to hold on to Him through the rough trials and if we stay true to Him, we come out of these trials stronger in our faith.
2. Remember this event in the Bible?
John 9:1
And as Jesus passed by, he saw a man which was blind from his birth.
John 9:2
And his disciples asked him, saying, Master, who did sin, this man, or his parents, that he was born blind?
John 9:3
Jesus answered, Neither hath this man sinned, nor his parents: but that the works of God should be made manifest in him.
Therefore, sin is not always the reason bad things happen to Christians. The way you handle your situation can be a witness to your family and friends who do not know the Lord. Also remember Job? It is a book that I re-read many times while going through pain or trials. The best example to remember during our personal war is Jesus and what He went through for us.
Eccl 3:1
To every thing there is a season, and a time to every purpose under the heaven:
We are going to have seasons of peace and seasons of war in our life here on Earth. Some of these war times are going to only involve you. Maybe you have excruciating pain at times and you are all alone, because no one else feels that pain. No one can fully understand your pain, except Jesus. Some people have certain seasons of their lives where nothing good has happened and they look around and wonder, "Where is God?". They are in such grief and pain that no words of comfort or help could touch them. You need supernatural help. Something only God can provide. Take your grief and pain to Him and speak it out to Him. Tell Him everything! Tell Him how you can't take any more. Confess your weakness and sin. Confess your faith that has been shaken by this trial. Then tell Him you believe in His mighty Love and will never forsake Him, no matter what you go through. Ask Him for relief in Jesus Christ's Name. Remember that God is merciful and loving. He is the one Who can fix all your problems, but sometimes we have to be patient and let Him work things out in His time as it usually will effect other people and bring Glory to His Name.

I've always heard preachers say, "If everything is always going great for you and you don't have the devil on your back, then you better start taking a closer look at your spiritual life because something is wrong".
I sincerely hope that this will answer some questions that some of you may have had. Just remember that God will never let you down. Keep holding to His Hand. If you've gotten to the point that you can't pray anymore because you don't see anything happening, then call someone that you know will pray for you right then and there. Sometimes we get to the point that we just have to rely on brothers and sisters in Christ to pray us through our trials.
As you can see, the Bible does gives us some answers to our "Why?" I'm sure there are some things we will not understand until we reach our everlasting home in Heaven. Please, never give up on Jesus!

Introduction
There is no emergency in this case. The plaintiffs,
themselves, argue that Steven Dunifer has been broadcasting
for at least one and 1/2 years with low power wattage. The
FCC has had pending before it for that entire period of time
pleadings which challenge their regulatory scheme. Rather
than responding to those pleadings, and the issues raised
therein, the FCC now comes to this court seeking an
injunction.
The declarations filed by the plaintiffs indicate that
they are scrupulously monitoring the broadcasts of Radio Free
Berkeley, and know precisely when and how often it broadcasts.
If there were truly any immediate threat of injury or harm to
anybody, why did they wait for over 18 months to bring it to
this court's attention?
The obvious answer is that there is no immediate harm
posed by Radio Free Berkeley's broadcasts. There are micro-
radio broadcasters all over the country challenging the FCC's
authority to limit the issuance of radio licenses to only
wealthy commercial broadcasters. The questions posed by this
lawsuit should be resolved through thorough litigation on the
merits of the issues. An injunction as this point would only
reinforce the arbitrary and discriminatory regulatory scheme
enacted by the FCC. It would deny what little non-commercial
democratic voice exists over the airwaves and it would protect
no interests that require immediate protection.
Argument
On June 1, 1993, the F.C.C. issued a Notice of Apparent
Liability (N.A.L.) against defendant Stephen Dunifer, in which
the F.C.C. sought to impose a forfeiture of $20,000 against
defendant for allegedly engaging in two unlicensed low power
FM broadcasts. On June 28, 1993, defendant filed his Response
to the N.A.L. A copy of that Response is attached hereto as
exhibit A. We excerpt from that Response:
"The Federal Communications Commission (F.C.C.)
policies with regard to micro radio broadcasting have
failed to keep pace with the rapid proliferation of
technological advances in the field of communication.
The F.C.C.'s current regulatory scheme completely
prohibits micro radio broadcasters and their
listeners from accessing the public airwaves. To
enforce this absolute prohibition, the F.C.C. is
relying upon regulations, and case law applying the
regulations, which were intended solely for
application to large-scale, commercial broadcasters,
and which were promulgated long before the advent of
the technology that makes possible micro radio;
indeed, even before the advent of FM broadcasting.
The F.C.C.'s application of these regulations
violates the First Amendment rights of individuals
seeking to exercise those rights via methods and
mediums that were technologically impossible when the
regulations were created.
The cost of owning and operating a radio station has
skyrocketed into the hundreds of thousands and even
million dollar range, and participation in the
broadcast media has thereby become limited only to
large corporations. The individual seeking to
communicate and listen to others over the airwaves in
his or her local community is completely left out of
the licensing scheme if he or she cannot afford the
expenses entailed in purchasing, obtaining a license
for and operating a commercial broadcast station with
at least 100 watts of power.
Micro radio provides a format by which ordinary
people can communicate with one another over the
airwaves without interfering with the rights of
large-scale, F.C.C. licensed commercial stations or
their listeners. The F.C.C., however, has not
provided a means by which persons wishing to avail
themselves of this new technological opportunity can
legally do so. The problem is not that micro radio
broadcasters are refusing to comply with F.C.C.
licensing procedures. Rather, the fundamental
problem is that the F.C.C. has not provided
procedures by which micro radio broadcasters can
become licensed or authorized. Instead, the F.C.C.
is applying severe administrative and criminal
sanctions, intended for application to large-scale,
commercial operators, to micro radio broadcasters
with the goal of completely precluding all such
broadcasts. The very notion of assessing a $20,000
forfeiture against Mr. Dunifer, an individual with no
prior F.C.C. violations, accused of transmitting two
low-power, non-commercial broadcasts of approximately
1 hour duration, is ludicrous.
It is the obligation of the F.C.C. to construct and
enforce its regulatory framework in such a way as to
safeguard the First Amendment right of free speech
for all persons, regardless of their economic power.
By totally prohibiting low-power micro radio, the
F.C.C. has failed to comply with its congressional
mandate to regulate the airwaves in the public
interest, has exceeded the limits of the power
conferred upon it by Congress, and is violating the
constitutional rights of micro radio broadcasters and
their listeners." Response to N.A.L., N.A.L./Acct.

After the F.C.C. denied defendant's June 28, 1993 request
for relief, defendant, pursuant to 47 C.F.R. SS1.115, filed
with the F.C.C. an Application for Review of Action Taken
Pursuant To Delegated Authority. That Application set forth,
in detail, the constitutional and procedural arguments as to
why the F.C.C.'s N.A.L in defendant's case, as well as the
absolute ban of all low-power FM broadcasting, is illegal.

and incorporated herein by reference. As of the date of this
filing, the F.C.C. has not acted upon that Application for
Review. At footnote 21 of the Application, defendant asks the
F.C.C. to provide defendant with any rules or authority that
would permit him to seek and obtain F.C.C. authorization to
engage in low-power FM broadcasts. The F.C.C. has not
responded to that request for the simple reason that no
regulations exist by which defendant or any other citizen can
apply for or be granted F.C.C. authorization to engage in low
power FM broadcasts.
Defendant's formal application for F.C.C. review has been
pending for nearly a year and a half with absolutely no
response or action by the F.C.C. In July of this year, the
Court of Appeals for the D.C. Circuit struck down the entire
administrative fine structure upon which the F.C.C. relied to
levy its $20,000 fine against plaintiff. Now, plaintiff comes
to this Court seeking the extraordinary relief of a Temporary
Injunction, claiming imminent and irreparable harm.
In his Answer to the plaintiff's Complaint, Defendant
will set forth in detail the constitutional and procedural
reasons why the F.C.C.'s regulatory scheme must be rejected by
this Court. At this juncture, however, there are several
compelling reasons why this Court should reject plaintiff's
request for injunctive relief:
1) The F.C.C., itself, has pending before it documents
which seek to permit Mr. Dunifer to broadcast with low-power
transmissions. They have been sitting on those documents for
over a year without acting on them. They should be compelled
to respond to those arguments, even if their response is to be
in the negative, before seeking the assistance of this court.
2) Evidence to be presented at hearing will demonstrate
that Mr. Dunifer, if authorized to broadcast at a low-power
frequency by the F.C.C. can insure that agency that his
transmissions will not interfere with emergency channels, or
with other licensed broadcasters. The transmitters he has
created possess the same ability to insure filtering and
frequency accuracy as any officially approved by the F.C.C.
Because of the F.C.C.'s current licensing scheme which
completely prohibits all low power FM broadcasting, there are
no means by which Mr. Dunifer can get formal approval to
broadcast with these transmitters. At trial, expert evidence
will be presented to demonstrate the adequacy of these devices
to broadcast without interference.
On the rare occasions in the past when Free Radio
Berkeley broadcasts did possibly interfere with another
channel, it immediately went off the air, corrected any
problem that caused the interference or moved to a frequency
where such interference would not occur.
The Communications Act of 1934, section 324, requires
that broadcasters use the "minimum amount of power necessary
to carry out the communications desired" for their broadcasts.
Instead of authorizing micro-broadcasting, the F.C.C. licenses
stations with tens of thousands of watts. These high-power
stations (some of which are as powerful as 100 kilowatts)
result in frequent reception difficulties due to the
overloading of the FM receivers possessed by many individuals,
thereby preventing the reception of nearby F.C.C. licensed
broadcast signals of a lessor power. This problem results in
a much greater degree of interference than anything that could
be accomplished by a micro-broadcaster.
At trial, defendant will offer expert testimony to
support his representation that his transmitters meet all
technical requirements which are constitutionally imposed by
the F.C.C.
3) Mr. Dunifer is currently accused of broadcasting for
a 3-hour period once a week from the Berkeley Hills. In an 18
month period, the F.C.C. has cited to only two possible
occasions when they believe Mr. Dunifer interfered with
another station. Evidence at trial will demonstrate that many
stations actually licensed by the F.C.C. regularly interfere
with other potential broadcasters more frequently than any
interference alleged to have been caused by Mr. Dunifer, and
with more harmful results.
4) Plaintiffs cite to this Court the Ninth Circuit's
decision in U.S. v. Nutri-Cology, 982 F.2d 394 (1992) for the
proposition that the government has met their burden of
showing the "irreparable injury" required before this Court
can grant the Temporary Injunction. As that decision clearly
states, however, the fact that a statutory violation is
alleged does not relieve the government of its obligation to
make a showing of irreparable injury. 982 F.2d 394,398.
Indeed, in Nutri-Cology, both the district court and the Ninth
Circuit found the government had failed to make an adequate
showing of irreparable injury, and both courts denied the
government's request for injunctive relief. A primary factor
in the Court's decision was that the statutory violation
alleged was "substantially disputed, and has been disputed
since 1982." 982 F.2d 394,398. Also of importance to the Court
was the considerable delay in the government's seeking relief.
982 F.2d 394, 396. Immediately following the passage quoted by
plaintiffs in their Points and Authorities Memorandum (p.6),
the Court stated:
"However, in statutory enforcement cases where the
government can make only a "colorable evidentiary
showing" of a violation, the court must consider the
possibility of irreparable injury." 982 F.2d 394,398.
In the present case, as in Nutri-Cology, the alleged
statutory violation is disputed, and has been consistently
disputed from the inception of the still-pending
administrative proceedings. Furthermore, the only injury
alleged by the government here consists of the two minor
incidents in which Free Radio Berkeley has been said to have
interfered with the licensed broadcasts of a high school radio
station late on a Sunday night. As defendant has repeatedly
pointed out to the F.C.C. (see exhibits A and B), the agency's
allegations of potential interference with aircraft
navigational broadcasts have never been documented, and are
spurious.
If there is irreparable harm to be found in this case, it
is the on-going policy of the F.C.C. to license only the rich,
and a handful of educational institutions, that creates such
harm. Technology currently exists to allow thousands of
Americans to have access to the airwaves in ways that could
assure their democratic use and a meaningful voice in the
democratic process. Instead, the F.C.C. has created a system
whereby the public listens, and the elite broadcast.
Allowing Steven Dunifer to continue broadcasting within a
5 - 30 watt limit on a frequency that is not being used by
other licensed broadcasters poses a threat to no one. Mr.
Dunifer is willing to inform the F.C.C. as to what frequency
he will be broadcasting from, and what the wattage will be, if
the F.C.C. will permit him the opportunity to continue
broadcasting during the pendency of these proceedings. This
court has the power and discretion to seek such a compromise
from the F.C.C. during these proceedings. Such would provide
an excellent test case regarding the opposing assertions made
by the parties herein. The F.C.C. has refused to acknowledge
that there could be safe, non-interfering micro-power
broadcasts, and have made no provisions for authorizing them.
The myriad of constitutional violations set forth in
exhibits A and B, which arise as a result of the F.C.C.'s
decision to preclude the poor from having any access to the
airwaves, must not be sanctioned by this court. There are
numerous less restrictive alternatives to the current
licensing scheme enforced by the F.C.C. that would provide the
American people with use of the airwaves.
For the reasons set forth in the Response and Application
currently pending before the F.C.C., their request for a
Temporary Injunction should be denied. The F.C.C.'s current
regulations result in the prior restraint of speech, the
suppression of diverse ideas, and the unavailability of the
airwaves for democratic communications in this country. Those
are the rights which defendant seeks to vindicate in this
proceeding, and he should not be cut short at this stage by
the unfounded accusations of the plaintiffs.

Had defendant, rather than plaintiff, come to this Court seeking
injunctive or declaratory relief, the F.C.C. would be vehemently urging
denial of review pending exhaustion of administrative remedies. In fact, in
a very similar case, Dougan v. F.C.C., 94 C.D.O.S. 2735, No. 92-70734 (9th
Cir. 1994) the F.C.C. argued to the Ninth Circuit that the only avenue for
judicial review in these cases is appeal to the District Court after the
F.C.C. has initiated formal enforcement proceedings to seize the forfeiture
amount.
